Smith accused of shooting ex-wife's Mercedes-Benz during argument

DETROIT – Local 4 has photos of a bullet-riddled Mercedes-Benz allegedly shot at by State Sen. Virgil Smith during an argument with his ex-wife outside his Detroit home.

Smith is accused of firing several shots from a rifle into his ex-wife's Mercedes-Benz about 1 a.m. Sunday outside his home on Wexford Street. Sources said the incident stemmed from an argument between Smith and his ex-wife when she discovered Smith's girlfriend at the home. No one was hurt in the shooting.

Photos of the vehicle show several bullet holes in the front driver's side.

Smith is charged with domestic violence, felonious assault, malicious destruction of property and felony firearm. He was arraigned this week, posted bond and is scheduled to be back in court May 22 for a probable cause hearing.

"The alleged actions of Sen. Smith cannot and will not be tolerated.  We asked for further work on the warrant and the information was received this morning. We let the facts and evidence guide our charging decision and nothing else," said Wayne County Prosecutor Kym Worthy.

Smith is a Democrat representing Michigan's 2nd Senate District. He's been in the Legislature since 2003. He has been removed from his Senate committees and relieved of his caucus responsibilities while the case moves through court.

His colleague, Sen. Bert Johnson, said Smith is considering a resignation.

"There is talk of expulsion or resignation, whichever comes first," said Johnson. "We all have kept the three of them in our prayers. I just hope the best for everybody involved."
