Chubby Checker sues over manhood measurement app

Singer Chubby Checker is suing Hewlett Packard and Palm Inc., in federal court in Fort Pierce, Fla., over the app called "The Chubby Checker" for unauthorized use of Checker's name and trademark.

The 71-year-old asserts that the app, which bears his name and is used to estimate the size of a man's penis based on his shoe size, infringes on his trademark and uses his name without permission.

The singer, whose real name is Ernest Evans, says that the unauthorized use of Checker's name and trademark will "blur and tarnish" his trademark by associating the Checker name with "obscene, sexual connotation and images." Checker is seeking a half-billion dollars in damages and restitution.

Hewlett Packard notes that the application was removed in September 2012 and is no longer available on any Palm or HP hosted web site.
