Activist's lawsuit to remove Roy Roberts from Detroit Public Schools struck down

Lawsuit filed by Robert Davis, court says Roberts has power through Public Act 72

DETROIT – The Michigan Court of Appeals has struck down a lawsuit requesting the removal of Roy Roberts as the emergency manager of Detroit Public Schools.

The lawsuit was filed by Highland Park's Robert Davis, an activist who has filed several suits challenging aspects of Michigan's emergency manager laws.

He says since Public Act 4 doesn't exist anymore, there is no law in effect to give Roberts his power. But in their ruling, the Appeals Court said Roberts was appointed under Public Act 72 -- a weaker version of the law that existed before PA 4 that is still in existence.

"Roberts was appointed under PA 72 after PA 4 was suspended and thus lawfully holds office," the ruling reads.
